1. Agreement to Terms

By accessing or using Secret Gifts ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by SecretGifts, based in the United Kingdom.

2. Description of Service

Secret Gifts is a free online platform that enables users to:

  • Create and manage gift exchange groups
  • Invite participants via email
  • Automatically match Secret Santa pairs
  • Communicate anonymously with matched partners
  • Share gift preferences and wishlists

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You must be at least 16 years old to create an account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Send spam or unsolicited communications
  • Impersonate others or provide false information
  • Attempt to gain unauthorised access to the Service
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Upload malicious code or content
  • Violate any applicable laws or regulations

5. User Content

You retain ownership of content you submit to the Service (preferences, messages, group information). By submitting content, you grant us a licence to use, store, and display it as necessary to provide the Service.

You are solely responsible for your content and must ensure it does not violate these Terms or any applicable laws.

6. Group Management

As a group creator, you are responsible for:

  • Obtaining consent from individuals before adding their email addresses
  • Managing group membership appropriately
  • Setting reasonable spending limits and exchange dates

We are not responsible for disputes between group members regarding gifts, participation, or other matters.

7. Anonymous Messaging

The anonymous messaging feature is provided to facilitate gift-related communication between matched partners. Misuse of this feature, including harassment or inappropriate content, may result in account termination.

8. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by SecretGifts and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components

10. Limitation of Liability

To the maximum extent permitted by law, SecretGifts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or data
  • Service interruptions
  • Disputes between users
  • Failed or unsatisfactory gift exchanges

Our total liability shall not exceed the amount you paid to use the Service (if any).

11. Indemnification

You agree to indemnify and hold harmless SecretGifts and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
